3. Nature and scope of the Services
The Provider offers the following categories of Service:
- Individual services - one-to-one psychological consultation and psychotherapy, delivered remotely (online) or, where agreed, in person. These are personalised clinical services.
- Couple and family services - remote or in person therapy or counselling for two or more related people together (for example partners or family members). These are clinical services delivered to more than one person at the same time.
- Therapeutic group services - remote or in person group counselling or group therapy, in which several clients take part together under the Provider’s facilitation. These are clinical services delivered in a shared setting.
- Self-discovery and personal-development groups - remote or in person groups, circles or programmes focused on learning, reflection and personal growth rather than treatment. These are developmental and educational, not clinical treatment.
- Professional supervision - clinical or professional supervision provided to other practitioners (for example psychologists, counsellors or trainees). This supports the supervisee’s professional practice and is not personal therapy for the supervisee.
- Educational and on-demand services - live webinars, workshops, events, courses and pre-recorded on-demand content on psychological and wellbeing topics. These are educational and informational in nature.
Educational, self-discovery and on-demand services are for general information, learning and personal development. They are not personalised advice, not a diagnostic or treatment service, not psychotherapy, and do not create a therapeutic or clinical relationship. Professional supervision is a professional-development relationship and is not personal therapy. Nothing in any of these services should be relied on as a substitute for individual professional care.
The individual, couple, family and therapeutic-group Services are forms of psychological support. They do not involve any physical or medical examination. They are not a medical diagnostic service, do not constitute medical treatment, and do not replace assessment or care by a physician, psychiatrist or emergency service. The Provider does not issue medical diagnoses or prescribe medication.
The Services are not suitable for emergencies or acute crises. If you are in crisis or at risk of harm to yourself or others, see the Crisis Protocol in Part III and contact the emergency services immediately.
4. Copyright and intellectual property
The Website and its content are protected by copyright and other intellectual property rights. Content may be reproduced only with the Provider’s explicit prior consent and with a clear citation of the source. “Mental Freedom” and related marks are used by the Provider as its own branding or based on agreements.
5. Eligibility and age
The Services are offered to adults. By booking, you confirm that you are 18 years of age or older and are not placed under judicial guardianship (interdiction) that would prevent you from entering into this agreement.
6. Booking, prices and payment
- Fees depend on the type and duration of the Service and are agreed before the Session is confirmed. The applicable Fee is the one communicated to you at the time of booking.
- Payment is made in advance, by bank transfer or another method offered at booking. A Session is treated as booked from the moment you receive an explicit confirmation of the appointment.
- The Provider may change Fees and Service features for future bookings. Any change is published in advance and applies only to bookings made after the change takes effect. It never affects a Session you have already booked and paid for.
7. Cancellation, rescheduling and missed sessions
You may cancel or reschedule a Session free of charge up to 48 hours before the scheduled start time. Cancellations within that window, and sessions you do not attend without notice, are charged in full, because the time has been reserved exclusively for you.
If the Provider cancels or is unable to deliver a Session (including for illness or technical failure on the Provider’s side), you will be offered a rescheduled Session or a full refund of that Session, at your choice.
If a technical failure on your side prevents a Session from starting, the Provider will make reasonable efforts to reconnect or reschedule. If reconnection is not possible within a reasonable part of the session time, the standard cancellation rule above applies, unless the parties agree otherwise.
Webinars, events and courses
For paid live webinars, workshops, group events and courses, your place is confirmed on payment. Refund and transfer terms are shown at registration. Unless stated otherwise, you may cancel for a full refund up to 7 days before the event; after that a place may be transferable to another date but is not refundable, as capacity is reserved for you.
If the Provider cancels or reschedules an event, you will be offered a place on the rescheduled event or a full refund. Live events may be recorded; if so, this is stated at registration (see clause 8a on group privacy).
On-demand content
On-demand Content is sold for immediate digital access. Access is granted for the period and on the terms shown at purchase, for your personal, non-commercial use only. You may not copy, share, resell or publicly show the content without the Provider’s written consent.
8. Right of withdrawal (EU consumers)
As a consumer contracting at a distance, you normally have 14 days to withdraw from a contract for services without giving a reason.
Because the Services are usually scheduled and delivered soon after booking, the following applies: if you ask for a Session to be delivered before the 14-day withdrawal period ends, you acknowledge that once the Session has been fully performed you lose the right of withdrawal for that Session. For any Session not yet delivered, you keep the right to withdraw and to a refund, subject to the cancellation rule in clause 7.
For On-demand Content and other digital content supplied without a physical medium, if you ask to start accessing it before the 14-day period ends, you acknowledge that once access begins you lose the right of withdrawal for that content. This will be made clear, and your acknowledgement obtained, at the point of purchase.
8a. Participating in groups, events and supervision
In any live group Service (therapeutic groups, self-discovery groups, webinars and events), other participants may see and hear you and anything you choose to share. The Provider cannot control or be responsible for how other participants use what is shared, so please share only what you are comfortable disclosing in a group setting.
Self-discovery groups, webinars and events are educational and do not carry the individual clinical confidentiality that applies to one-to-one Sessions. Therapeutic groups are clinical, and the confidentiality position specific to them is set out in clause 9.
You agree to take part respectfully and not to record, capture or redistribute a group, event or its materials without the Provider’s written consent. The Provider may remove a participant whose conduct disrupts the work or harms others, without refund where the removal is justified.
Professional supervision is a one-to-one or small-group professional relationship for practitioners. The Supervisee is responsible for handling their own clients’ information appropriately when presenting cases (see clause 9).
9. Confidentiality (clinical Services)
This clause applies to clinical Services. Everything you share is treated as confidential and is handled in line with professional ethical standards and Part II of this document.
Confidentiality may be limited only where the Provider is ethically or legally required to act, in particular:
- where there is a serious and imminent risk to your life or safety, or to the life or safety of another identifiable person;
- where there is a concern about the safety or welfare of a child or a vulnerable person;
- where disclosure is required by a court or by law.
Where it is safe and practicable, the Provider will discuss any such disclosure with you first. See Part III for how this works in practice.
Routine clinical supervision of the Provider’s own work
As a standard part of responsible practice, the Provider takes their own casework to regular professional supervision. This means aspects of your work may be discussed with the Provider’s supervisor for the purpose of maintaining the quality and safety of your care. Such discussion is anonymised so far as possible, is itself bound by professional confidentiality, and is shared only with the supervisor and only to the extent needed. This is a normal safeguard that supports your care, not a disclosure of the kind described above.
Couple and family work
In couple and family work, the Provider’s duty of confidentiality runs to the outside world, not between the people in the room. Information shared in joint sessions is known to everyone present. The Provider does not keep secrets between partners or family members and will agree a shared “no-secrets” approach at the start. All adults taking part must consent to the work, and any recording or sharing of session content requires the agreement of everyone present.
Therapeutic groups
In therapeutic groups, what other members share is confidential to the group, but the Provider cannot guarantee that other members will keep it confidential. Each member is asked to commit to confidentiality, and you should share only what you are willing to disclose in that setting. The Provider’s own confidentiality duties, and their limits above, still apply.
Supervision
In professional supervision, discussion focuses on the Supervisee’s practice and cases. The Supervisee is responsible for presenting client information in line with their own confidentiality and data-protection duties, normally without directly identifying their clients. Supervision is not personal therapy for the Supervisee, and the Provider may need to raise concerns through the appropriate professional channel where practice or client safety requires it.
10. Professional supervision
This clause applies where the Provider delivers clinical or professional supervision to another practitioner (the “Supervisee”). Supervision supports the Supervisee’s professional development and the quality and safety of their practice. It is not personal therapy for the Supervisee, and it does not make the Provider responsible for the Supervisee’s clients or clinical decisions.
10.1 Purpose and scope
Supervision may include reflecting on the Supervisee’s cases, methods and professional conduct, and supporting their learning against the standards of their profession. The specific focus, frequency and format are agreed between the Provider and the Supervisee before supervision begins.
10.2 Responsibilities of the Supervisee
- The Supervisee remains fully responsible for their own clients, their clinical decisions, their records and their professional obligations. Supervision advice is non-binding reflection, not instruction, and does not transfer that responsibility to the Provider.
- The Supervisee is responsible for presenting client information lawfully and ethically, normally without directly identifying clients, and in line with their own confidentiality and data-protection duties. As set out in Part II, the Supervisee remains the data controller for their own clients’ data.
- The Supervisee confirms they hold their own professional indemnity/liability cover as required for their practice.
10.3 Responsibilities of the Provider
- To provide supervision with professional skill and care and within the Provider’s areas of competence.
- To keep proportionate, secure records of supervision, as described in Parts II and clause 10.5.
- Where the Provider becomes aware of a serious concern about client safety or professional conduct, to raise it with the Supervisee and, where necessary, through the appropriate professional or regulatory channel.
10.4 Confidentiality and its limits
Supervision discussions are confidential between the Provider and the Supervisee, subject to the same limits that apply to clinical Services in clause 9 (serious risk of harm, safeguarding, or legal requirement) and to the professional-conduct concern described above. Confidentiality within supervision does not override either party’s duties toward the Supervisee’s clients.
10.5 Records, reports and accreditation
Where supervision counts toward the Supervisee’s training, accreditation or registration, the parties agree in advance what records or confirmations the Provider will keep and provide (for example logs of hours or attendance). The Provider confirms only what is accurate and within the Provider’s knowledge, and is not obliged to provide any endorsement that would not be professionally justified.
10.6 Booking, fees and cancellation
Unless the parties agree a separate written supervision arrangement, the booking, fee, payment and cancellation terms in clauses 6 and 7 apply to supervision sessions in the same way as to individual Sessions.
11. Delivery, technology, recording and communication
Sessions are delivered online, or in person where the parties agree. The delivery mode for your Sessions is agreed at booking.
Where Sessions are delivered online, they take place using the video or audio tool the Provider uses for this purpose: Google Meet or Zoom. For online Sessions you are responsible for a private space, a stable connection and a suitable device. Where Sessions are in person, practical details such as the venue, arrival and any on-site requirements are advised at booking. In both cases the Provider uses reasonable technical and organisational measures to protect the confidentiality of Sessions.
Sessions are not recorded unless both parties expressly agree in advance and in writing, and the purpose and storage of any recording are documented. Between Sessions, please use only the agreed channels for contact. E-mail and messaging are not monitored continuously and must never be used for urgent or crisis matters.
12. Cross-border practice and jurisdiction
The Provider is based in Bulgaria and is regulated under Bulgarian law and professional standards of the Bulgarian Association of Psychotherapy. Provider’s registration number with BAP is № 101/2024.
If you access the Services from outside Bulgaria, you are responsible for confirming that receiving online psychological services from a Bulgaria-based practitioner is appropriate and lawful in your country of residence. The Provider may decline or discontinue Services where local law, clinical safety or the practicalities of remote work make this necessary.
13. Limitation of liability
The Provider delivers the Services with professional skill and care but does not guarantee any specific outcome. To the extent permitted by law, the Provider is not liable for indirect or consequential loss, or for outcomes arising from information you withhold, from your failure to follow agreed safety steps, or from your use of the Services in a way they are not intended for. Nothing in these Terms limits liability that cannot be limited by law.
14. Complaints and dispute resolution
If you are unhappy with any aspect of the Services, please contact the Provider first at info@todorsimeonov.eu so the matter can be addressed directly.
If sufficient resolution cannot be reached, you can address your concerns with the Bulgarian Association of Psychotherapy at psychotherapy-bg.org.
As an EU consumer, you may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr, and you may contact the competent Bulgarian consumer-protection authority. This does not affect your right to bring proceedings before the competent courts.
15. Changes to these Terms
The Provider may update these Terms from time to time. The current version is always published on the Website with its effective date. Changes apply to bookings made after the change takes effect; they do not retroactively alter a Session already booked and paid for.
16. Governing law
These Terms are governed by the substantive and procedural law of the Republic of Bulgaria, together with applicable EU law, including mandatory consumer-protection rules of the country where you habitually reside where those apply to you.
